Age UK, a prominent charity in Britain dedicated to supporting the elderly, has been instructed to provide compensation for age discrimination. An employment tribunal found the charity guilty and ruled that they must pay over £4,000 to a 58-year-old individual, Alexander Cubbin, who was unfairly treated during the job application process.

Cubbin, who has mental health issues and qualifies for an automatic interview under the government’s Disability Confident Scheme, was rejected for the position of brand asset designer without his application even being considered. The tribunal learned that an administrative error led to Cubbin receiving a generic rejection email, indicating that he would not be invited for an interview. Despite Age UK’s participation in the Disability Confident Scheme, Cubbin was denied the opportunity he was entitled to.

In his CV, Cubbin highlighted his extensive experience in the industry, spanning over 40 years, including 14 years of voluntary work. He expressed his eagerness to continue working and emphasized that he was not ready to retire. However, instead of acknowledging the administrative mistake, Age UK attempted to justify their actions.

The tribunal revealed that the successful applicant for the position was significantly younger than Cubbin, contradicting the charity’s initial explanation. Furthermore, the senior brand identity manager at Age UK, Rebecca King, provided Cubbin with a harsh post-application review, criticizing his qualifications and personal traits in an unprofessional manner.

Cubbin described King’s review as a direct attack on his character, causing him distress and humiliation. The tribunal concluded that Age UK’s actions were unjustifiable and that the charity should have simply apologized for the error. Despite expressing disappointment with the ruling, an Age UK spokeswoman affirmed the charity’s commitment to diversity and inclusion in their recruitment practices.
